Conclusion of Contract and Contracting Party
The contract is only concluded upon acceptance of the order by the company Pro Keepers Line GmbH. The acceptance of the order takes place by sending an order confirmation via e-mail. The customer's contractual partner is exclusively the company Pro Keepers Line GmbH, represented by its Managing Director Artak Amirkhanian, with its registered office at Industriestraat 34, 5931 PJ Tegelen, The Netherlands. By placing an order, you accept our terms of delivery and payment. Pro Keepers Line GmbH reserves the right to adjust its terms of delivery and/or payment over time. The prices at the time of the order always apply. Prices are shown in Euro and include the applicable statutory VAT. Special offers may be created for bulk purchasers upon request. The minimum order value is €25.
Delivery and Shipping
Delivery of the ordered items will only take place after receipt of payment. All orders are shipped via UPS. Goods are shipped exclusively from our warehouse in the Netherlands (Tegelen). The applicable shipping costs are displayed during the ordering process and are to be borne by the customer.
Refusal of Acceptance
If the customer refuses acceptance of the goods without there being an obvious defect or without having expressly exercised the right of withdrawal beforehand, we consider this as a return within the scope of the right of withdrawal. In this case, the customer shall bear the direct costs of the return shipment. We will deduct these costs (the fees charged by UPS for the return transport to the Netherlands) from the refund amount.
Right of Withdrawal (Returns)
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.
The direct costs of returning the goods shall be borne by the customer, unless the delivered goods do not correspond to the order or are defective. Please do not send packages back to us unpaid (freight collect/carriage forward). UPS charges high penalty fees for unpaid shipments and cross-border returns, which we would have to invoice you for or deduct from the refund amount.
You must send the goods back to us immediately and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired. The item should ideally be in its original packaging and must be in a resalable, undamaged, and complete condition. Personalized products (e.g., printed gloves) are generally excluded from return.
If you have ordered multiple items, you can return some of them individually or together. Pro Keepers Line GmbH reserves the right to demand compensation for value if items are returned later than 14 days after withdrawal or are no longer in their original condition (e.g., signs of use). Items can only be returned with a delivery note/invoice and sufficiently stamped.
After acceptance of the return by Pro Keepers Line GmbH, the customer has the following choice: The amount of the returned items (minus the return costs to be borne by the customer) will be refunded by Pro Keepers Line GmbH to the customer within 14 days, or the customer can receive the amount as a credit on their customer account. Please note that the refund of the purchase price will only take place after receipt and inspection of the returned items in our warehouse in Tegelen. Applicable Law
The law of the Netherlands shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. If you placed the order as a consumer and have your habitual residence in another country (e.g., Germany) at the time of your order, the application of mandatory legal provisions of that country remains unaffected by the choice of law made in sentence 1.
Online Dispute Resolution
The European Commission provides a platform for Online Dispute Resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/. We are not obliged and not willing to participate in a dispute settlement procedure before a consumer arbitration board.
