Terms and Conditions

1. Contracting Party and Scope

These General Terms and Conditions apply to all orders placed through the online shop of Pro Keepers Line.

These T&Cs apply to both consumers and businesses. A consumer is any natural person who places an order for purposes that are predominantly outside their trade, business or profession. A business is any natural or legal person acting in the exercise of their trade, business or profession when concluding the contract.


2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to place an order.

By clicking the order button, you submit a binding offer to purchase the goods contained in the shopping cart.

The contract is concluded when we confirm your order by e-mail or dispatch the goods. We reserve the right to reject an order, in particular if a product is not available, payment problems exist, an obvious pricing or product error is present, or there is suspicion of misuse, fraud or commercial resale without prior consent.

After receiving your order, you will receive an automatic confirmation of receipt by e-mail. This merely confirms that your order has been received by us and does not yet constitute acceptance of the contract unless expressly designated as an order confirmation.


3. Prices, Minimum Order Value and Shipping Costs

The prices displayed in the online shop at the time of the order apply. All prices are stated in Euro and include statutory VAT unless expressly stated otherwise.

The minimum order value is 25 EUR.

In addition to the product price, shipping, packaging, administration or handling costs may apply. These costs are displayed during the ordering process before the order is completed.

For deliveries outside the European Union, additional customs duties, import taxes, fees and other import charges may apply. These costs are not included in the item price or shipping costs and are to be borne by the customer unless expressly stated otherwise at checkout.


4. Payment

Available payment methods are displayed at checkout. Delivery generally only takes place after successful receipt of payment.

When paying via external payment service providers, the terms and conditions of the respective payment service provider also apply. This applies in particular to PayPal, credit card, Apple Pay, Google Pay, iDEAL, Bancontact, SEPA, BLIK, eps, Multibanco, OXXO, Przelewy24 or other payment methods offered at checkout.

We reserve the right not to offer individual payment methods in individual cases or to process an order only after full payment confirmation.


5. Delivery and Shipping

Shipping is carried out from our warehouse in Tegelen, The Netherlands. We ship via UPS or another shipping service provider selected by us, unless otherwise stated at checkout.

Estimated delivery times are displayed in the shop or at checkout. Delivery times generally begin after receipt of payment and processing of the order.

Delivery delays caused by shipping service providers, customs authorities, public holidays, force majeure, strikes, extreme weather conditions or other circumstances beyond our control cannot be completely ruled out.

If a delivery is returned due to incorrect, incomplete or non-deliverable address details, lack of cooperation by the customer, non-collection or refusal of acceptance, the resulting costs may be deducted from the refund amount or charged separately, insofar as legally permissible.


6. Refusal of Acceptance and Uncollected Shipments

If the customer refuses acceptance of the goods without justified reason or fails to collect a shipment in time, the customer shall bear the resulting return shipping costs, storage costs, customs costs or other additional costs, insofar as legally permissible.

The statutory right of withdrawal remains unaffected by this. However, a mere refusal of acceptance does not necessarily replace an explicit declaration of withdrawal.


7. Retention of Title

The goods remain our property until full payment has been made.

In relation to businesses, the goods remain our property until full settlement of all claims arising from the ongoing business relationship.


8. Right of Withdrawal for Consumers

Consumers are entitled to the statutory right of withdrawal. Details can be found in our separate withdrawal policy.

The direct costs of returning the goods shall be borne by the customer unless the goods were delivered incorrectly or are defective.

In the event of a complete withdrawal, we will refund the purchase price including the cheapest standard delivery costs. Additional costs for a more expensive shipping method chosen by the customer will not be refunded.

In the event of a partial withdrawal, we will only refund the purchase price of the returned products. Delivery, shipping, packaging, administration and handling costs will not be refunded in the event of a partial withdrawal.


9. Returns

Returns must be sufficiently stamped, securely packaged and, where possible, sent with tracking. Within the EU, we do not provide a free return label.

For returns from outside the EU, please contact us in advance at info@prokeepersline.com. In certain cases, we can arrange a return or collection via UPS. The costs for this amount to 29.95 EUR and are to be borne by the customer.

The goods remain the responsibility of the customer until they are received at our warehouse. We therefore recommend insured shipping with tracking.


10. Condition of Returned Goods and Compensation for Diminished Value

The goods may only be inspected to the extent that would also be possible in a retail store. Use of the goods beyond this inspection is not permitted.

Please return the goods complete, clean, undamaged and, where possible, in the original packaging. The original packaging, in particular shoe boxes, must not be used as a shipping carton. Shipping labels, adhesive tape or markings must not be applied directly to the original packaging.

In the case of used, soiled, damaged or incomplete goods as well as damaged original packaging, we may demand compensation for diminished value and deduct this from the refund amount. If the goods can no longer be resold as new due to their condition, the compensation for diminished value may amount to up to 100% of the purchase price.


11. Personalised Products

The right of withdrawal does not apply to goods that are not prefabricated and for the manufacture of which an individual selection or determination by the customer is decisive or which are clearly tailored to the personal needs of the customer.

This applies in particular to personalised products, individually printed goalkeeper gloves, custom-made products or products with customer-specific adjustments, provided there is no defect.

Once personalisation has begun, an order can no longer be changed or cancelled free of charge, insofar as legally permissible.


12. No Direct Exchange

We do not offer direct exchanges. If you wish a different size, colour or product, please place a new order in our online shop.


13. Product Information, Images and Availability

Product images serve as illustrations. Minor deviations in colour, design, packaging, model year or details may occur, provided they are reasonable for the customer and do not affect the essential characteristics of the product.

Size specifications, fit information and recommendations serve as guidance and do not guarantee a specific fit.

Should an ordered product not be available, we will inform you immediately. Payments already made will be refunded in this case.


14. Vouchers, Discount Codes and Promotions

Vouchers, discount codes and promotional offers are only valid for the specified period and only under the respective stated conditions.

Discount codes cannot be applied retrospectively to orders already completed. Cash payment is excluded.

We reserve the right to cancel or reject vouchers, discount codes or promotions in the event of misuse, technical errors or obvious mistakes.


15. Warranty and Manufacturer's Guarantee

Statutory warranty rights apply.

Any manufacturer's guarantee exists in addition to the statutory warranty rights and does not restrict them.

Normal wear and tear, improper use, incorrect care, damage caused by external influences or use contrary to manufacturer instructions do not constitute a defect.


16. Liability

We are fully liable for intent, gross negligence, injury to life, limb or health, and in accordance with mandatory statutory provisions.

In the event of slightly negligent breach of material contractual obligations, we are only liable for the foreseeable, contract-typical damage. Material contractual obligations are those obligations whose fulfilment is essential for the proper performance of the contract and on whose compliance the customer may regularly rely.

Otherwise, liability is excluded insofar as legally permissible.


17. Customer Account and Misuse

The customer is obliged to treat their customer account login credentials confidentially and to protect them from access by third parties.

We reserve the right to block, review or reject customer accounts or orders if there is suspicion of misuse, fraud, unauthorised resale, multiple accounts to circumvent restrictions or other improper use.

When contacting us regarding orders, please provide your order number if possible so that we can process your concern more quickly.


19. Dispute Resolution

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.


20. Applicable Law

Dutch law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer and have your habitual residence in another country, mandatory consumer protection provisions of that country shall remain unaffected.


21. Contract Language and Contract Text

The contract language shall be determined by the language you select in the online shop. The contract text will be stored by us. You will receive the order data by e-mail after completing the order.


22. Final Provisions

Should individual provisions of these T&Cs be or become invalid, the validity of the remaining provisions shall remain unaffected.

Amendments to these T&Cs shall apply to future orders. For orders already concluded, the terms valid at the time of the order shall apply.
